 Quite a lot of diverse rebuttals and responses from different forces and students populace was met after the release of the ISRC Instrument/Act by the SRC president; Mr. Adu Baah Charles, which said law received his assent on the 3rd of July 2020.
I wrote to address the issue which held a lot of illegalities and a clear example of disregard for the democracy of the SRC.

As issues arose after the release of the notice, one, Mr. Boakye Dankwah Asare, brought an application for interim injunction before the SRC Judicial Committee, to restrain the SRC president from enforcing the ISRC Act 2020.

The night of Sunday, 5th July 2020, was a night of strong legal banter and debate between the applicant’s counsel and the legal team of the SRC.

 After almost four hours of heated debate from both sides of the matter, the panel of five (5), ruled unanimously in favour of the applicant; Mr. Boakye Dankwah Asare. The ISRC Act by virtue of this case, was directed to the SRC Parliamentary Council for thorough legislative procedures and a constitutional resolution to be made regarding the purported law.

The ruling of the Superior court exposes the undemocratic and unconstitutional step the SRC sought to take.

The questions which still hold in the cognitive of every student regardless are;


  • ARE THE CHECKS AND BALANCES AND SEPARATION OF POWERS RECOGNIZED IN THE CHAMBERS OF THE SRC?
  • WHY WAS SUCH HASTY AND ILLEGAL ACT PASSED WITHOUT THE CONSENT OF THE SRC PARLIAMENTARY COUNCIL?
  • WHAT IS THE NEXT APPROACH TAKEN BY THE SRC PARLIAMENTARY COUNCIL IN ADDRESSING SUCH PERTINENT ISSUES AS THE ISRC ACT?
  • DOES THE SRC AFTER ALL PRIORITIZE THE INTERESTS OF STUDENTS IN DECISION MAKING?


All these questions need very strong and responsive address by the SRC. I am hoping that the SRC Parliamentary Council due to the diverse issues this ISRC Act has brought, will apply the best of knowledge and constitutional approach in respect of upholding the interests of students highly.
